Terms of Service for Craft Down Under

1. Acceptance of Terms

By accessing or using the services provided by Craft Down Under ("CDU", "we", "us", or "our"), you agree to comply with the following terms and conditions (the "Terms"). These Terms govern your access to and use of our software, forums, games, servers, and related services (collectively, the "Services"). Non-acceptance of any of these Terms requires that you stop using the Services immediately.

2. Changes to Terms

We reserve the right to change, modify, or revise these Terms at our sole discretion. Changes are effective immediately upon posting. Your continued engagement with our Services constitutes your binding acceptance of such modifications.

3. User Accounts

  • Account creation requires providing current, complete, and accurate information. We reserve the right to suspend or terminate accounts associated with information that is inaccurate, outdated, or incomplete.
  • You are responsible for safeguarding your account information and assume liability for all activities under your account.
  • We may suspend, limit, or terminate your account and access to Services for violations of these Terms or any illegal activities.

4. User Conduct

You must adhere to all applicable local, state, national, and international laws and regulations. Harassment, infringement on the rights of others, and any action that interrupts or impedes the operational integrity of the Services is strictly prohibited.

5. Refund Policy

All purchases made are final and non-refundable, subject to our sole discretion and applicable laws and regulations. Exceptions may apply under specific circumstances, as outlined below:

  • Server Specific Purchases: Refunds may be issued for purchases related to a specific server if the server is retired within 31 days of the purchase, excluding force majeure events. Application for such refunds must be made promptly.
  • Force Majeure: We are not obligated to issue refunds for impacts related to events beyond our control, including natural disasters, acts of God, government actions, terrorism, computer errors or internet disruptions.
  • Service Issues: In cases of technical issues on our part that prevent access to or use of our Services, we may, at our sole discretion, offer refunds or credits for affected users.
  • Chargebacks: Initiating a chargeback will lead to immediate termination of your account. We reserve the right to challenge chargebacks and have a robust record of winning such disputes.

Each refund request will be evaluated on a case-by-case basis. We reserve the right to require proof and to deny refund requests as per our judgement in alignment with these Terms.

6. Service Modification and Termination

We may, at any time, modify, suspend, or discontinue the Services, or any part thereof, without prior notice or liability. We reserve the right to refuse service to anyone, for any reason, at any time.

8. Liability Limitation

To the maximum extent permitted by applicable law, CDU shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your access to or use of or inability to access or use the Services.

9. Governing Law

These Terms are governed by the laws of New South Wales, Australia, without regard to its conflict of law principles. You agree to the exclusive jurisdiction of the courts in New South Wales for any disputes arising under or in connection with these Terms or the Services.

11. Service Availability

We are committed to providing a superior user experience and we strive to ensure high levels of performance, security, and availability for all our services. However, all users acknowledge and agree that all services provided by Craft Down Under are offered on a "best effort" basis. This means that while we aim to minimize downtime and maximize performance, we do not guarantee uninterrupted, error-free service or consistent levels of performance and availability.

Our team works diligently to address any issues that arise and to continually improve the service. However, certain factors, including but not limited to, acts of God, natural disasters, technical failures, and malicious attacks, may occasionally result in service interruptions or degraded performance. In such events, we will make reasonable efforts to restore the services to full working order but we do not provide any guarantees regarding availability or performance.
